O STJ negou, na terça-feira passada o recurso especial ajuizado pelos donos da Buritirama Mineração e manteve a falência da empresa decretada originalmente pelo TJSP. Os controladores da empresa argumentavam que houve vícios no protesto, uma vez que os avisos e citações feitos pela Justiça aos responsáveis nunca encontraram estas pessoas nos devidos endereços. Alegavam que, em função da pandemia, todos estavam realizando trabalho de home office e que a mineradora tinha e tem interesse em ingressar com um pedido de recuperação judicial. 

Afirmou, também, que houve no caso nulidade da citação e ausência de interesse de agir por parte da credora. E que a falência deveria ser suspensa, em razão de ação cautelar de recuperação judicial já ajuizada.

Com 3,5 mil empregados, a Buritirama a terceira maior mineradora de manganês do mundo e a maior da América Latina.  

A decretação da falência pelo TJSP tomou como base inadimplência de dívida, que ultrapassa os R$ 27 milhões, reconhecida em decisão da 1ª Câmara de Direito Empresarial do TJSP, no julgamento de uma ação proposta pela empresa C. Steinweg Handelsveem.
