A recent circular from Spain's Directorate General of Public Function clarifies rules regarding leave for public employees following the December 2022 stabilization process.
Newly stabilized employees (career civil servants or fixed-term labor personnel) must remain in active service and cannot request leave immediately.
However, those who held permanent positions before the stabilization process can request leave of absence (excedencia).
This includes those seeking leave for incompatibility with another public sector job. They can exercise the option under Article 10 of Law 53/1984.
This provision has generated complaints from those who did not secure permanent positions. They argue that allowing those already employed to take leave creates more temporary positions.
